Terms and Conditions of Service for Life with Dogs Training and Behaviour a subsidary business of parent company Victoria Elsmore Photography

 

These Terms and Conditions (“Agreement”) govern the relationship between you (“Client” or “You”) and Victoria Elsmore of Life with Dogs Training and Behaviour (“we”, “us”, “our”), a company providing dog training and behavior services. By booking or receiving our services, you agree to abide by these terms and conditions.

 

1. Services Provided

 

We offer dog training and behavior modification services, which may include private training sessions, group classes,  consultations, and virtual training services. We offer one to one courses inclusive of three face to face meetings, reports and ongoing support. Our service can be booked with a one off payment of £245.00 which acts as a deposit to secure your service and the initial face to face meeting date.

 

2. Scheduling and Cancellations

 

- Booking: All training sessions must be scheduled in advance. Bookings can be made through our website. You can book a complimentary 15 minute telephone consultation to explore our terms of service and discuss how we can help you.

  

- Cancellations: You must provide at least 24 hours’ notice for any cancellation or rescheduling of appointments. Failure to do so will result in a cancellation fee of £95.00, and the session may be forfeited. For special consideration you can apply direct to Life with Dogs who at their discretion will consider reasons provided to include illness, ill health of dog or emergencies. 

  

- No-Shows: If you do not attend a scheduled appointment without prior notification, you will be charged a cancellation fee of £95.00

 

3. Payment

 

- Fees: Payment for services must be made in full at the time of booking unless otherwise agreed to secure your course and booking in appointment slot.

  

- Accepted Payment Methods: We accept BACS, credit or debit card, online payment via a secure gateway

  

- Refunds: All payments are non-refundable.

 

4. Client Responsibilities

 

- Dog Health and Safety: You are responsible for ensuring your dog is healthy and fit for training. If your dog is sick, injured, or in heat, please notify us prior to scheduling or attending a session. We recommend a veterinary health check prior to embarking on our course to ensure that behaviours are not caused by a health concern. We will not work on behaviour modification of a dog that is ill. It is your responsibility to ensure the health of your dog.

  

- Vaccinations: Your dog must be up to date on all vaccinations. Proof of current vaccinations may be required prior to services being provided.

  

- Behavioral Concerns: You are required to inform us of any aggressive tendencies or behavioral concerns your dog may have before beginning training.

- You are required to work with us in applying the prescribed training plan provided within your initial report and all subsequent reports and communications that may amend the plan either by phone or in written form (digital or otherwise)

- Life with Dogs Training and Behaviour and Victoria Elsmore accepts no responsibility for failed training programmes where participation according to the agreed writtern plan is not evident from you.

 

- You are expected to make payment to secure our services in a timely manner as detailed in the invoices provided and as part of the online booking process. 

 

 

5. Trainer Responsibilities

 

- Professional Conduct: We agree to provide services with professionalism and in accordance with the highest industry standards as detailed by the Internation Association of Animal Behaviour Counsellors and The National Institute of Canine Ethics and The UK Dog Charter

  

- Training Methods: Our trainers use humane and positive reinforcement-based methods. We do not condone or practice physical punishment or aversive methods during training.

 

6. Liability

 

- Assumption of Risk: You acknowledge that training your dog involves a certain degree of risk, including but not limited to injury to you, your dog, or others. You assume full responsibility for any such risk.

  

- Liability Waiver: You agree to hold Life with Dogs, its employees, contractors, and agents harmless from any and all claims, liabilities, damages, injuries, or losses arising from or related to your participation in the training and behaviour sessions.

 

7. Confidentiality

 

- Privacy: We will keep all information provided by you confidential. We will not disclose your personal information or your dog’s training progress without your consent unless required by law. Except in the circumstances detailed in points a. to d. below.

a. As part of our operation within UK industry lead standards we are required to keep open communication with the veterinary practise under which your dog is registered. You agree that we can share all information and communications pertaining to (and not limited to) your dogs behaviour, health, diet and training with your named veterinary practise. We operate a completely transparent service to all parties involved. 

b. You waive your right to confidentiality where your dog may be considered at risk of violence, injury or death as a result of actions of cruelty. 

c. Life with Dogs Training and Behaviour reserves the right to report any occasions where your dog's welfare is at risk to Local Authorities, your vet and welfare charities with the authority to act. This includes all incidences of cruelty or incidences where all of a dogs basic needs (according the the Animal Welfare Act 2006) are not being met. 

d. Life with Dogs Training and Behaviour reserves the right to report potentially dangerous dogs to the local authorities according to the Dangerous dogs act 1991.

 

8. Use of Media

 

- Photography and Video: During training sessions, we may take photographs or videos for training purposes or promotional use. By engaging our services, you consent to the use of these images or videos. If you do not wish for your dog’s image to be used, please inform us in writing prior to the session.

 

9. Termination of Services

 

- Termination by You: You may terminate services at any time by notifying us. However, no refunds will be provided where a course has already commenced (to include any number of visits, reports or ongoing communications or where you have failed to notify us of your intent to cancel at least 24 hours in advance.

  

- Termination by Us: We reserve the right to terminate services at any time if we believe your dog’s behavior is unsafe, or if you fail to adhere to these terms and conditions. No refunds will be provided.

- Termintation by us: We reserve the right to terminate services with immediate effect where we are treated aggressively, threatened or are concerned for our safety. We do not accept responsibility for the cancellation of a service where a memeber of our team has been treated poorly. No refunds will be provided. 

 

10. Governing Law

 

This Agreement is governed by the laws of the United Kingdom of Great Britain Any disputes arising from this Agreement will be resolved in the courts. 

11. Complaints Procedure

- All complaints must be addressed via our complaints procedure, which you can engage by emailing Victoria Elsmore directly at victoria.elsmore@icloud.com. Your complaint must containt the following words in the subject title to include the word complaint followed by  your name, date of service, name of dog.

- Once engaged your complaint will be responded to within 7 working days of the initial written date of submission as detailed on the email signature of the complaint sent. 

- We aim to resolve all complaints within 30 working days of the initial email contact, though this period may vary in certain instances. 

 

12. Amendments

 

We reserve the right to amend these Terms and Conditions at any time. Any changes will be posted on our website or communicated to you directly.

 

By engaging our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
